International Forensic Accounting


In the modern world, the extremes of behavior are becoming more apparent and are equally concerning.

As the result of a US Court decision awarding damages in relation to the oppressive and depraved conduct by a US couple on their maid, SV Partners were appointed to provide advice regarding the ability to maximise the realisation of assets subject to a freezing order. Further to this, we were requested to analyse the financial records in an attempt to find undisclosed assets for the purposes of supporting the judgment handed down.

The Case

The circumstances of the case involved a US couple detaining a woman whilst living in Japan, and subsequently abusing her on a regular basis. Unfortunately, the woman was from an underprivileged background, and her ability and capacity to counter the actions of the couple were diminished. As a result of the couple’s prosecution, they were ordered to pay the girl in excess of $US3 million. Following this order, the couple, then living in the US, fled to reside in Australia. The husband died shortly thereafter, and as a result of a private investigation, the wife was discovered to be living in Melbourne. The assets of the wife were then frozen.

An interesting adjunct to this matter is it involves the Australian Courts ratifying and upholding the decision of the US Courts. However, to support this outcome, SV Partners have been engaged to determine the extent of both the Australian and US assets, requiring significant detective work in identifying and tracing the undisclosed assets. SV Partners will provide advice as to the most advantageous manner to maximise the realisation of these assets, including taking into consideration any taxation implications.

The matter is ongoing and we will let you know the outcome.

It has been both an interesting and gratifying matter to be involved with.
